Learned counsel for the petitioner submits that the complaint lodged by the petitioner before the police authority against the private respondents has not been acted upon. It appears from the report submitted by the State that upon holding enquiry it was found that no criminal offence was made out. However, in the event the petitioner is aggrieved by the enquiry made by the police authority and non- registration of FIR pursuant to the complaint lodged by him, he is at liberty to approach the jurisdictional Magistrate under Section 175 of the BNSS. Since other prayers are not pressed by the petitioner, the writ petition is disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
