Heard Mr. D. Hussain, learned Counsel for the petitioner and Mr. B. Sharma, learned Additional Public Prosecutor for the State. 2. By this application, the petitioner has prayed for bail in connection with Sribhumi P.S. Case No. 210/2026, corresponding to GR Case No. 844/2026
Page No.# 2/3 registered under Sections 61(2) /318(4)/ 319(2)/ 308(7)/ 317(4)/ 351(2)/ 351(3)/ 111/ 3(5)/ 3(6)/ 3(9) of BNS, 2023. The FIR in connection with which the petitioner was arrested and was put behind the bars on 05.09.2026 was lodged by the police personnel of IBI, Sribhumi District stating inter alia that a group of persons possessing neither office nor authority nor any professional qualification has taken a position in an around the precincts of the Sribhumi Police Station and making a livelihood out of the same. It is alleged that the said group including the petitioner used to intercept the person, who come to the Police Station and by taking the character of an official or an advocate advise them to lodge an FIR or to enter into a settlement. It is also alleged that they fabricate and make false criminal cases and by their activities, they demand money from the public and they have amassed many. 3. The learned Counsel for the petitioner submits that the FIR has been lodged without any specific allegation against the petitioner or anybody else. He further submits that omnibus statements were made against the petitioner and that the petitioner is no way involved in the said offence. 4. On the other hand, Mr.

Sharma, learned Additional Public Prosecutor for the State by placing the arrest memo issued to the petitioner submits that petitioner is involved in cheating, exhortation, impersonation and criminal intimidation as stated in the FIR and that it is clear from the said grounds of arrest mentioned in the arrest memo that the petitioner had misrepresented himself as persons connected with the legal profession and had cheated the public. 5. Upon consideration of the submissions made by the learned Counsel for the parties, more so, in view of the fact that no specific allegation was made against the accused person i.e. the petitioner, this Court deems it fit to enlarge
Page No.# 3/3 the petitioner on bail on furnishing of bail bond of Rs. 20,000/- with one local surety of the like amount to the satisfaction of CJM, Sribhumi, under the following conditions: i) the petitioner will appear before the Investigating Officer as and when called for. ii) the petitioner will not hamper, tamper with the evidence, neither influence the witnesses connected with the case. iii) the petitioner will not leave the place of jurisdiction without the permission of the concerned Court. 6.
