JUSTICE SANJEEV KUMAR SHARMA ORDER Date : 15.09.2026 Heard Ms. S. Begum, learned counsel for the petitioner. Also heard the learned Additional Public Prosecutor appearing for the State. This is an application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 whereby the petitioner, Raj Kumar Chauhan, has prayed for granting him bail after he was arrested connection with Lanka P.S. Case No.158/2026 under Section 21(b)/27 of NDPS Page No.# 2/2 Act. As per the allegations, a quantity of 46.86 gm of heroin was recovered upon a personal search of the petitioner. The petitioner has spent 61 days behind the bars and charge-sheet is yet to be filed. The matter relates to intermediate quantity and the statutory period of detention is 60 days. Although Section 27(A) of NDPS Act has been incorporated in the FIR, upon perusal of the case diary, there does not appear to be sufficient material to attract the said offence. In view of the above, the petitioner is entitled to be released on bail. Accordingly, the petitioner named above shall be released on bail on furnishing a bail bond of Rs. 50,000/- with two sureties of the like amount to the satisfaction of learned jurisdictional Magistrate/Court.
