GP FOR REVENUE The Court made the following: 3 THE HONOURABLE SRI JUSTICE D.RAMESH WRIT PETITION No.370 of 2026 ORDER: The present writ petition is filed seeking the following relief: “….to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of Respondents No.3 to 9 in trying to demolish the structure and dispossesses me from land in an extent ofAc.0.03 cents in Sy.No.63/1 of Rangasamudram, Village, Porumamilla Mandal, YSR Kadapa District for formation of National Highway No.l67-B from Singarayakonda to Mydukkur Road without acquiring the same as per the provisions of the National Highways Act, 1956 and paying compensation as per Right to fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and following due process of law, as illegal, arbitrary, colourable exercise of power apart from being violative of the Fundamental and Constitutional right guaranteed to me under Articles 14, 19, 21 and 300-A of the Constitution of India and consequently direct the respondents not to interfere with our peaceful possession and enjoyment including any attempts of demolition of structure and building at land in an extent of Ac.0.03 cents in Sy.No.63/1 of Rangasamudram Village, Porumamilla Mandal, YSR Kadapa District….” 4 2. Heard learned counsel for the petitioner, learned Assistant Government Pleader for Revenue appearing for respondent Nos.1, 3, 5, 6, 8 and Sri Thandava Yogesh, learned counsel appearing for respondent No.2 3. Learned Assistant Government Pleader appearing on behalf of the respondents, on instructions, has submitted that the respondents have not intended to dispossess the petitioner, but for laying a service road, there is a requirement of the land of the petitioner and accordingly, they have already sent a proposal to initiate proceedings under Section 3A of the National Highways Act, 1956 (for short, „the Act‟) for additional acquisition. 4. Considering the said submissions, the Writ Petition is disposed of directing the respondents not to dispossess the petitioner from the subject land without following due process of law more specifically provisions of the Act.
