2. Heard the learned counsel for the petitioners and the learned Assistant Public Prosecutor. Perused the record.
3. As seen from the record, the criminal petition is filed challenging the proceedings in C.C. No.215 of 2024 on the file of the learned III Additional Chief Judicial Magistrate, Gajuwaka. The 2nd respondent lodged a report with the police, which was registered as a case in Crime No.129 of 2024 for the alleged offences punishable under Sections 448, 427, 341, and 506 read with Section 34 of the Indian Penal Code, 1860 (for brevity, “the IPC”). After thorough investigation, the police filed a charge sheet, having examined as many as six witnesses.
4. The witnesses, in categorical terms, in their statements recorded under Section 161 of the Code of Criminal Procedure, 1973 (for brevity, “the Cr.P.C.”), have alleged that the petitioners committed the offences mentioned supra. In view of the specific accusations levelled against the petitioners by the prosecution witnesses under Section 161 of the Cr.P.C., the proceedings on the file of the learned Trial Court cannot be quashed, as the matter requires adjudication at trial. Both parties are required to adduce their evidence, and the petitioners have to prove their innocence before the learned Trial Court.
5. Be that as it may, the learned counsel for the petitioners submits that a legal notice was issued to the 2nd respondent seeking partition of the property among them.
3
6. Considering the facts and circumstances of the case, the Criminal Petition is disposed of with a direction to the learned Trial Court not to insist upon the personal presence of the petitioners unless their presence is specifically required in accordance with law. The petitioners are at liberty to approach the learned Trial Court by filing an appropriate application for discharge, and upon such application being filed, the learned Trial Court is
directed to bestow its attention and dispose of the same as expeditiously as possible. No order as to costs.
As a sequel, Miscellaneous petitions, if any pending, shall stand closed.
