Heard Mr. H.P Guwala, learned counsel for the petitioner. Also heard Mr. M.P Goswami, learned Addl. P.P appearing for the State. Invoking under Section 483 BNSS, the petitioner namely, Paresh Choudhury, is seeking regular bail in connection with Mayong PS Case No.
Page No.# 2/3 53/2024 u/s 87/127(2)/64(1)/351(2) BNS, 2023. The petitioner was arrested on
20.06.2024. The FIR dated 15.06.2024 lodged by the victim woman herself with allegations of abuse and forceful physical relationship, including threatening. The learned counsel submits that the petitioner and the victim were having a love affair and subsequently, due to some misunderstanding, an FIR has been lodged and the petitioner is languishing in custody. It is submitted by the prosecution that investigation is already complete. The learned Additional PP, Mr. Goswami, submits that in the said statement, she has implicated the petitioner and therefore, prosecution is opposed to the bail. Scanned Case Diary is available. Perused the statement of the victim under section 183 BNSS. In her statement under section 183 statement, she has not stated about a love affair. In view of the length of detention and completion of investigation, I am inclined to allow this bail petition, subject however to suitable conditions. In such view of the matter, the petitioner is allowed to go on bail on furnishing a bail bond of ₹40,000/- with one surety of the like amount to the satisfaction of the concerned learned court, (CJM Morigaon), and subject to the conditions that: (i) He shall be available for trial when if one commences. (ii) He shall not hamper or tamper with evidence. (iii) He shall not in any manner intimidate, harass, or harm the informant/victim girl in any manner. Violation of the bail conditions will entail cancellation of the bail as per law.
