Dubey, learned counsel for the petitioners and learned P.P. for the State. The petitioners are apprehending their arrest in connection with Nimdih P.S. Case No.08/2026. It has been alleged that the accused persons on the basis of false genealogical table, had executed sale-deeds in favour of their wives and also got the land mutated. Submission has been advanced by the learned counsel for the petitioners that with respect to the same set of land, a suit has already been instituted for declaration of right, title and interest being Original Suit No.34/2024. Learned counsel submits that even otherwise the allegations leveled against the petitioners appears to point towards a civil dispute. Learned P.P. for the State opposed the prayer for anticipatory bail of the petitioners. Regard being had to the aforesaid facts, I am inclined to extend the privilege of anticipatory bail to the petitioners. Accordingly, the petitioners above named are directed to surrender in the court below within four weeks and pray for bail, and in that event, they shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each, 2026:JHHC:15439 to the satisfaction of learned A.C.J.M. at Chandial in connection with Nimdih P.S.
