GP FOR HOME The Court made the following: ORDER: The Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief :- “…to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus questioning the action of the 5th respondent interfering in civil disputes and threatening to evict the possession of house property bearing D.No.1/60 situated opposite to Nandi Statue, Lepakshi Village, Lepakshi Mandal, Sri Satya Sai District Erstwhile Anantapur District without following any procedure known to law and forcing the petitioner to settle the civil matter with the brother of the petitioner as illegal, arbitrary and without jurisdiction and consequently direct the respondents not to ' interfere with the civil disputes relates to petitioner and pass” 2. Heard the learned Counsel for the Petitioner and the learned Assistant Government Pleader for Home. 3. Sri P. Narahari Babu, learned Counsel for the Petitioner, submits that Respondent No. 5 has been interfering in the civil dispute of the Petitioner and prays that the writ petition be allowed. 4. Sri P. Ajay Babu, learned Assistant Government Pleader for Home, on oral instructions, submits that there is a dispute between the father and son regarding the property, and in that context, Respondent No. 5, for the purpose of conducting a preliminary inquiry, has called the Petitioner. Having regard to the facts and circumstances of the case, and recording the submissions of the learned Assistant Government Pleader, the Writ Petition is disposed of directing henceforth the Respondent police not to interfere in the civil dispute of the Petitioner with regard to the house property bearing D. No. 1/60, situated opposite Nandi Statue, Lepakshi Village, Lepakshi Mandal, Sri Sathya Sai District, except in accordance with due process of law. 6. In the result, the Writ Petition is disposed of.
