After arguing for some time, learned counsel for the petitioner prays for withdrawal of writ petition and submits that petitioner may be granted liberty to approach before the learned trial Court along with complete medical documents with respect to the present status of the petitioner till date. 2. The submission made by counsel for the petitioner is not opposed by the State counsel.

In view of the submissions made by counsel for the petitioner, the present petition is dismissed as withdrawn with liberty to approach before the concerned trial Court along with the entire medical documents of the petitioner by which he is claiming to be sick and not able to attend the Court for recording of his evidence.
4. In such eventuality, it is expected that the trial Court shall decide the application in accordance with law considering the documents submitted by the petitioner.
