Heard learned counsel for the petitioner, learned Standing Counsel for the respondents and perused the record. The present writ petition has been preferred challenging an order dated 21.07.2026, whereby claim of the petitioner seeking modification of her posting has been rejected. Brief facts of the case are that the petitioner was appointed on 29.08.2011 on the post of Assistant Teacher (Home Science) in G.G.I.C. Amroha (Jyotiba Phule Nagar). She was transferred to Baghpat on 01.01.2013. The promotional list has been published on 12.03.2025 and online applications were invited for giving choice of place of posting. Pursuant thereto, the petitioner being 75% disabled moved an application giving her choices mentioning five colleges where she requested for posting, however the said application has been rejected by the order impugned without posting the petitioner at the place of her choice. It has been contended by learned counsel for the petitioner that the aforesaid order impugned has been passed without considering the circular dated 24.08.2026, wherein it has been mentioned under Clause 5(4) of the transfer policy of the year 2026-27, preference has to be given to physically handicapped persons while posting them. Learned Standing Counsel could not dispute the aforesaid position. Having heard learned counsel for the parties and perusal of record, this Court finds that the ends of justice would be subserved by remitting the matter back to the respondent no. 2 – Director of Education (Basic), U.P., Allahabad to consider the petitioner's grievance in view of instructions issued in circular dated 24.08.2026 and pass an order in accordance with law Versus Counsel for Petitioner(s) : Mohd.
