Petitioner claims to be the owner of LR Plot No. 1343 within Mouza – Gomokpota in the district of Paschim Medinipur. Petitioner alleges that the local villagers are using the petitioner’s khamar and courtyard land for public thoroughfare. Petitioner has referred to an order dated December 2, 2025 passed in WPA 24362 of 2025 wherein the respondent authorities were restrained by an order of injunction from taking steps to utilise the property of the petitioner for the purpose of construction of road, concrete or otherwise, without due process of law. Petitioner has now approached this Court alleging that the villagers are indiscriminately using the plot of the petitioner as a public thoroughfare. 2 Learned advocate appearing for the petitioner could not demonstrate that there is failure n the part of the respondent authorities to perform the public duties. For such reason this Court is not inclined to entertain this writ petition. Accordingly, this writ petition stands disposed of. (Hiranmay Bhattacharyya, J.)
