1. Petitioners have filed this writ petition seeking following reliefs:
“10.1 This Hon'ble Court may kindly be pleased to call for the entire records in relation to the pending payment of arrears on time bound pay scale of the petitioners, for its kind perusal. 10.2 This Hon'ble Court may further kindly be pleased to issue appropriate writ(s)/order(s)/direction(s) to the respondent authorities for payment of arrears on time bound pay scale to the petitioners. 10.3 This Hon'ble Court may further kindly be pleased to issue appropriate writ(s)/order(s)/direction(s) to respondent authorities to decide the representation filed by the petitioners for payment of arrears on time bound pay scale. 10.4 That this Hon'ble Court be pleased to grant such other relief(s) in favour of the petitioners, as it may deem fit and proper in the interest of justice. 10.5 Cost of the petition may also be granted to the petitioners.”

Learned counsel for the petitioners submits that petitioners are working on different posts with respondent -Department. Petitioners have been given time-pay scale after completion of requisite period of service vide order dated 04.09.2023 (Annexure P-2) . Hence the petitioners are entitled for time-pay scale with effect from the date as mentioned in the order. However, petitioners were not extended arrears
4 / 4 of time-pay scale but benefit was extended from the date of order i.e.
04.09.2023. He submits that in the facts of case when petitioners have been held entitled for time-pay scale from back date, petitioners are also entitled for arrears of said benefit, which is not paid. Petitioners had already submitted representation before respondent No.3 which is pending consideration and therefore a direction be issued to respondent No.3 to take decision on the claim of petitioners at the earliest within specified time.

Learned counsel for the State submits that he is having no objection to the limited prayer made by learned counsel for petitioners.

On due consideration of submission of learned counsel for parties this writ petition is disposed of with a direction to respondent No.3 to consider and take decision on representation submitted by petitioners dated 24.04.2025 in accordance with law expeditiously preferably within a period of 3 months from the date of receipt of copy of this order.
5. Petitioners will also be at liberty to submit fresh comprehensive representation if they so desire and if such representation is submitted concerned authority shall consider and take decision on representation to be submitted by petitioners along with pending representation. Sd/Sd/-
