Learned counsel for the petitioner submits that the controversy involved herein is squarely covered by the order dated 02.04.2024 passed by the Co-ordinate Bench of this Court in S.B. Civil Writ Petition No. 4728/2024 titled Shubham Kumar Vs. The State of Rajasthan & Ors. (Annexure-7). 2. It is further submitted that the instant petition may be disposed of with direction that upon the petitioner filing a [2026:RJ-JP:33882] (2 of 2) [CW-16860/2026] representation in light of the Division Bench judgment of this Court in D.B. Special Appeal Writ No. 815/2019 titled State of Rajasthan and Ors. vs. Poonam Sharma, the competent authority be directed to decide the same in accordance with law. 3. Heard the submissions advanced by learned counsel for the petitioner. 4. This Court deems it appropriate to dispose of the instant petition with liberty to the petitioner to file a detailed representation before the competent authority of the respondents. 5. It is directed that if such a representation is filed, the competent authority of the respondents is directed to consider and decide the same strictly in accordance with law, keeping in mind the ratio laid down in Poonam Sharma (supra) and Shubham Kumar (supra). 6.
