IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No. 4006 of 2026 Abinash Lohar …. Petitioner Mr. G. Parida, Advocate -versus- State of Odisha …. Opposite Party Mr. C.R. Swain, AGA CORAM: JUSTICE V. NARASINGH Order No. ORDER 30.04.2026 01. 1. Heard learned counsel for the Petitioner and learned counsel for the State. 2. The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.569 of 2026 pending on the file of learned J.M.F.C., Rural, Rourkela, arising out of Lathikata P.S. Case No.70 of 2026, for commission of offences punishable under Sections 122(2)/125(a)/115(2)/296/3(5) of BNS. 3. It is submitted by the learned counsel for the Petitioner that because of the long standing civil dispute between the family of the Petitioner and the informant, series of cases have been instituted against him by the very same informant and her family. Hence, the criminal antecedents as referred to by the learned counsel for the State in opposing the prayer for pre-arrest bail ought not to weigh with this Court in considering the present application. 4. So far as maintainability of application in the face of the offences being ex-facie bailable is concerned, it is submitted that because of the background of litigation inter se between the parties, there is reasonable apprehension that the Petitioner may be implicated for commission of non-bailable offence. 5. Considering the nature of allegation and the background in which the same is made, it is directed that in the event of arrest of the Petitioner in connection with the aforesaid case, he shall be released on bail by the Arresting Officer on such terms and conditions deemed just and proper with further conditions that he will cooperate with the investigation. 6. Violation of any of the above condition(s) shall entail cancellation of bail. 7. Accordingly, the ABLAPL stands disposed of. 8. U.C.C. as per rules. (V. NARASINGH) Judge Santoshi
