Accused no.1 is before this Court in this Criminal Petition filed under Section 528 of BNSS, 2023 with a prayer to quash the entire proceedings in C.C.No.22399 of 2025 pending before Court of XXXII Addl. Chief Judicial Magistrate, Bengaluru arising out of Crime No.16/2025 registered by North Women Police Station, Bengaluru City for the offence punishable under Section 85 r/w Section 3(5) of BNS, 2023 and Sections 3 & 4 of the Dowry Prohibition Act,1961 insofar as it relates to the petitioner herein. 2. Learned counsel for the parties jointly submit that, dispute between the petitioner and respondent no.2, who are husband and wife has been amicably settled at the intervention of well-wishers and elders of both the parties. The settlement arrived between the parties is voluntary without their being any undue influence or coercion. The parties have today filed - 3 - HC-KAR NC: 2026:KHC:12070 CRL.P No. 1249 of 2026 application under Section 359 of BNSS, 2023 r/w Section 528 of BNSS, 2023 seeking permission of this Court to compound the offences, for which the petitioner has been charge sheeted. Accordingly, they pray to allow the petition. 3. The parties, who are present in person before the Court are identified by their learned advocates. Application filed by the parties under Section 359 of BNSS, 2023 is taken on record. The said application is supported by the affidavit of the petitioner and respondent no.2. In paragraph no.4 of the joint affidavit filed by petitioner and respondent no.2, it is stated as follows:- "4. We state that, at the intervention of elders and well-wishers, we have amicably agreed to resolve our dispute, and we have decided to reunite and lead life peacefully. As such, we do not wish to continue with the court cases. We wish to culminate our disputes inter se and consent to compound the above case. Therefore, I am filing this application to compound the offences and acquit/quash the petition as prayed for along with joint affidavit. Hence, accompanying application." 4. The petitioner and respondent no.2, who are husband and wife have resolved their dispute and have decided to live peacefully in future. Under the circumstances, I am of - 4 - HC-KAR NC: 2026:KHC:12070 CRL.P No. 1249 of 2026 the opinion that, this is a fit case, wherein this Court needs to quash the impugned criminal proceedings in order to do complete justice to the parties, who are before this Court. 5. Accordingly, Criminal Petition is allowed. The entire proceedings C.C.No.22399 of 2025 pending before Court of XXXII Addl. Chief Judicial Magistrate, Bengaluru arising out of Crime No.16/2025 registered by North Women Police Station, Bengaluru City for the offence punishable under Section 85 r/w Section 3(5) of BNS, 2023 and Sections 3 & 4 of the Dowry Prohibition Act,1961 are hereby quashed.
