Learned counsel for the petitioner submits that the petitioner was not apprehended at the spot. His name does not find mention in the FIR. It is submitted that the co-accused is merely the petitioner's brother-in-law and, being relatives, there were some telephonic conversations between them. This is a digitally signed order. Apart from the disclosure statement of the co-accused, there is no material to connect the petitioner with the alleged offence. 4. Per contra, learned APP for the State submits that the case pertains to an international syndicate engaged in a racket of stealing Remote Radio Units (RRUs), which form part of mobile towers. It is submitted that out of the 43 RRUs recovered, 17 had already been reported stolen in various criminal cases registered across different States. Further, out of the 9 RRUs transported by co-accused Fareed and Sher Mohammad on behalf of the petitioner, 6 RRUs have already been linked to theft cases registered in Delhi and Noida. 5. Learned APP further submits that the custodial interrogation of the petitioner is necessary to unearth the entire conspiracy. However, ever since the date of the raid, the petitioner has been absconding. His mobile phone has remained switched off, and he has failed to respond to the notice issued under Section 35(3) of the BNSS, requiring him to join the investigation. 6. The Court has heard learned counsel for the parties. 7. The role attributed to the petitioner is that, in conspiracy with his brother-in-law, Fareed, and other associates, he was engaged in the sale and purchase of stolen RRUs procured from suppliers operating in Rajasthan. Thereafter, the stolen RRUs were transported from Rajasthan to Uttar Pradesh through buses. During the course of the investigation, certain bus drivers and conductors involved in the transportation have also been identified and are yet to be examined. 8. In the aforesaid circumstances, this Court is of the view that the custodial interrogation of the petitioner is necessary to unearth the entire conspiracy. In view of the sequence of events and the material collected during the investigation, no ground for grant of anticipatory bail is made out. This is a digitally signed order.
