Heard learned counsel for the applicants and learned AGA for the State. 2. Present application has been preferred with the prayer to quash the charge-sheet dated 14.09.2018 and cognizance/summoning order dated 22.09.2018 as well as entire proceedings of Criminal Case No.35628 of 2018 (State Vs. Brijpal and Others), arising out of Case Crime no.585 of 2018, under Sections 406, 420, 409, 467, 468, 471, 120B IPC, P.S. New Agra, District- Agra, pending before learned court of Civil Judge (Junior Division) II, Agra. 3. On perusal of entire record appended with the instant application, this Court does not find it to be a case where interference of this Court is required. No such ground appears to be available in the present application, on the basis of which, impugned charge-sheet, cognizance/summoning order and entire criminal proceedings of the said case, can be set aside. 4. Accordingly, the prayer sought through the instant application, is refused. 5. Lastly, learned counsel for applicants submits that till today charges have not been framed against the applicants and as such learned court concerned is hereby directed that at the time of framing charges, the same may be framed in the light of judgement rendered by Hon'ble Apex Court in the case of Delhi Versus Counsel for Applicant(s) : Kamlesh Kumar Dwivedi, Prashank Mishra Counsel for Opposite Party(s) : G.A. Brijpal Singh And Another .....Applicant(s) State of U.P. and Another .....Opposite Party(s) Race Club (1940) Ltd. and others vs. State of Uttar Pradesh and another reported in 2024 10 SCC 690. 6.
