Heard Ms. Gunjan Singh holding brief of Sri Rajiv Chowdhury, learned counsel for the applicant and learned A.G.A for the State as also perused the record. This application under Section 529 BNSS has been filed seeking direction to the court concerned to conclude the proceeding of Case No. 1728 of 2011 (State vs. Anwar and others), arising out of Case Crime No. 78 of 2011, under Sections 379, 411 IPC, Police Station Luxa, District Varanasi, pending before the court of learned Civil Judge (S.D.)/Fast Track Court, Varanasi, within stipulated period. Learned counsel for the applicant submits that cognizance upon the charge sheet has been taken on 03.11.2011 and summons were issued against the applicant as well as other accused persons, but till today, neither the charges were farmed against the accused persons nor evidence has been started. Learned counsel for the applicant, therefore, submits that, considering the considerable period for which the proceedings have remained pending, a suitable direction may be issued to the court concerned for expeditious disposal of the aforesaid case. Looking to the aforesaid circumstances, it is directed that trial pending before the concerned court be concluded expeditiously, as early as possible, preferably within one year, from the date of filing of certified copy of this order, in accordance with the provisions of Section 309 of the CrPC (Power to postpone or adjourn proceedings) corresponds to Section Versus Counsel for Applicant(s) : Rajiv Chowdhury Counsel for Opposite Party(s) : G.A.
