[2026:RJ-JP:14672] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. (Presently In Central Jail Ajmer). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Atul Sharma For Respondent(s) : Mr. Vivek Chaudhary, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR
Order 08/04/2026
1. The instant second bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No. 122/2025 registered at Police Station Haribhau Upadhyay Nagar, District Ajmer for the offences under Sections 8 and 22 of NDPS Act.
2.
Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. It is contended that the first bail application of the petitioner was dismissed vide order dated 31.01.2026 considering the fact that from petitioner's possession commercial quantity of MDMA was recovered, however after investigation it was revealed from the FSL report that contraband recovered from the petitioner's possession was not MDMA rather MD. Commercial quantity of MD is 50 gram. The accused- petitioner is in custody since 02.12.2025 and the charge-sheet has already been submitted. The trial of the case may take considerable
[2026:RJ-JP:14672] (2 of 2) [CRLMB-5022/2026] time, therefore, the bail application of the accused-petitioner may be allowed.
3. Learned Public Prosecutor has vehemently opposed the bail application.
4. Heard and perused the material available on record.
5. Considering the arguments advanced by learned counsel for the parties and looking to the fact that in the FSL report contraband allegedly recovered from the petitioner's possession was found to be MD and presence of MDMA was not detected, the commercial quantity of MD is 50 gram earlier the petitioner's bail application was dismissed by this court observing that commercial quantity of MDMA was recovered from the petitioner, however considering the FSL report it is apparent that the recovered contraband was found to be containing MD, therefore considering the fact that the recovered quantity of MD from the petitioner's possession is below commercial quantity, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail.
6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Devendra Jangid @ Deva @ Devraj S/o Shri Jagdish Jangid, in connection with FIR No. 122/2025 registered at Police Station Haribhau Upadhyay Nagar, District Ajmer shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
