ORAL ORDER
Petitioners – accused Nos.1 and 2 are before this Court calling in question proceedings in C.C.No.71/2025, pending before the Judicial Magistrate – I Class – Traffic Court – 1, Mayo Hall, Bengaluru, for the offences under Sections 125(a), 125(b) and 281 of the BNS and Sections 146 and 196 of the Indian Motor Vehicles Act.

Learned counsel for the petitioners and respondent No.2 would in unison submit that during the subsistence of these proceedings, the parties to the lis have entered into settlement amongst themselves by drawing up certain terms and conditions. The parties have filed an application – I.A.No.1/2026 under Section 359 r/w. 528 of the BNSS, with

supporting affidavits of the parties before this Court seeking permission to compound the offences.
3. The affidavit of the complainant reads as follows:
“2. I submit that I don't want to continue the proceedings against the Petitioners; I want to compound the alleged offences with the petitioners, since I have compromised with the petitioners out of the court and have no objections to quash the proceedings initiated against the petitioners in C.C. No.77/2025 originated from Crime No. 92/2024 of the respondent Shivajinagara Traffic police for the offences punishable under sections 125(a), 125(b), 281 of BNS and 146 r/w 196 of IMV Act which is pending on the file of the Hon'ble Judicial Magistrate First Class Traffic Court-1 Mayo Hall, at Bengaluru.
3. I submit that I am swearing this Affidavit with my own free will and consent, there is no coercion or force from any one. I therefore pray that this Hon'ble court be pleased to accept my affidavit and kindly allow the petition filed by the petitioners.
I, the deponent above named do hereby declare that what is stated above is true and correct to the best of my knowledge, information and belief.”
In the light of the afore-quoted affidavit of the complainant filed along with the application, I deem it appropriate to terminate the proceedings against the petitioners, as the dispute and the allegations are between the individuals and not against the State.

4. For the aforesaid reasons, the following:
O R D E R
(a) The criminal petition is disposed. (b) The proceedings in C.C.No.71/2025, pending before the Judicial Magistrate – I Class – Traffic Court – 1, Mayo Hall, Bengaluru, qua the petitioner, stand quashed.
