In this petition, the petitioner seeks the following reliefs:
"a) Issue Writ in the nature of Certiorari or any other Writ or Order or Direction in the similar nature quashing Provisional List dated 06.01.2026 vide Annexure-E issued by; the 5th respondent authority in so far as it relates to Sl. No.7 and endorsement bearing No.ShiAaYo/Sri/Hi.Ku/2025-26/940 dated 17.02.2026 vide Annexure-G issued by the 5th respondent authority holding the same are illegal and without application of mind; b) Issue Writ in the nature of Mandamus or any other Writ or Order or Direction in the similar nature directing the 4th and 5th respondent authorities to consider the candidature of the petitioner vide Annexure-B and appoint her to the post of Anganawadi Worker at Yadaruru- Anganwadi Centre, Sreeenivasapura Taluk, Kolar District; c) Grant such other relief or relief's as this Hon'ble Court may deem fit to grant in the
facts and circumstances of the case in the interest of justice and equity."

Learned counsel for the petitioner, in addition to reiterating the various contentions urged in the petition and referring to the material on record, invited my attention to the Notification at Annexure-A dated 06.09.2025 in order to point out that when the petitioner applied to the post of a Anganwadi

HC-KAR NC: 2026:KHC:13275 WP No. 6881 of 2026 worker pursuant to the said Notification, the marks of 329, which she had secured in her II PUC examination was considered to be lesser than the marks secured by the rival candidate Smt. Yashoda, who had secured 380 marks apart from the fact that additional 5 marks was to be granted/conferred in favour of the petitioner who had also obtained a Diploma in Nursery Teacher Training, the same would have the effect of granting priority in favour of the petitioner over the aforesaid candidate though the said candidate had secured more marks than the petitioner. 3. In this context, learned counsel for the petitioner would invite my attention to the Notification at Annexure-D1 dated 03.12.2022, in particular clause IV (2). 4. Per contra, learned AGA would invite my attention to the subsequent Notification at Annexure-H dated 17.02.2025 which was in force as on the date of issuance of the aforesaid Notification dated 06.09.2025 calling for appointment to the post of Anganwadi worker in order to point out that the discrepancy/ambiguity as regards priority being given to a holder of a Diploma course in addition to 5 marks to be granted

HC-KAR NC: 2026:KHC:13275 WP No. 6881 of 2026 in his/her favour has been clarified by the respondents, who have categorically stated that the aspiring candidates would be entitled to only additional 5 marks and only in the event of 2 candidates being found to have secured equal marks that the priority would be given in favour of a candidate possessing a Diploma certificate and as such, since the petitioner had secured 329 marks, which was lesser as against 380 marks secured by the rival candidate, the subsequent Notification dated 03.09.2025 would apply and the respondents were fully justified in not including the name of the petitioner in the Provisional List dated 06.01.2026 and issuing the Endorsement at Annexure-G dated 17.02.2026 rejecting the claim of the petitioner. 5. Clause IV of the Notification dated 03.12.2022 at Annexure-D1, reads as under:

7. I have given my anxious consideration to the rival
submissions and perused the material on record.

It is an undisputed fact that as on the date of the Notification issued by respondent No.4 for appointment to the post of Anganwadi worker and helper dated 06.09.2025, the aforesaid Notification dated 17.02.2025 was in force and as per the said notification, a person holding a Diploma certificate would be entitled to additional 5 marks and only in the event of two rival candidates securing equal marks in the PUC Board exam that priority would be given in favour of a candidate possessing a Diploma certificate.
9. In the instant case, it is an undisputed fact that while the petitioner had secured 329 marks in her II PUC examination, the rival candidate Smt. Yashoda had secured 380 marks and since both the said marks were not equal, priority

Under these circumstances, I am of the considered opinion that the respondents were fully justified in issuing the impugned Provisional List dated 06.01.2026 (Annexure-E) and Endorsement dated 17.02.2026 (Annexure-G), which is in accordance with law and the question of interfering with the same would not arise in the facts and circumstances of the instant case.
11. Insofar as the judgment of the Apex Court in the case of Government of Andhra Pradesh v. P.Dilip Kumar and another [(1993) 2 SCC 310] relied upon by the petitioner is concerned, the said judgment would not be applicable to the factual matrix involved in the present case and as such, no reliance can be placed on the same.
