JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by accused No.3 under Section 438 of Bharatiya Nagarik Suraksha Sanhita, 2023 praying to grant anticipatory bail in Crime No.229/2020 of Hennur Police Station pending in SC No.810/2021 on the file of the learned XXVI Additional City Civil and Sessions Judge at Mayo Hall (CCH-20), Bangalore, registered for offence punishable under Section 302 of IPC. 2. Heard the learned counsel for petitioner and the learned High Court Government Pleader for respondent/State. 3. The learned counsel for the petitioner would contend that the petitioner was granted bail by order - 3 - HC-KAR NC: 2026:KHC:8240 CRL.P No. 14908 of 2025 dated 22.10.2020 passed in Criminal Miscellaneous No.25780/2020 and was released on bail. Thereafter, the petitioner appeared in S.C. No.810/2020. He remained absent on 27.09.2021. The case against him has been split up by order dated 29.08.2023 and split up case is registered in SC No.1351/2023. As the petitioner has not appeared, the Trial Court has issued NBW against him. As NBW issued against the petitioner, he apprehends his arrest. It is submitted that the petitioner belongs to the third gender. It is further submitted that due to a miscommunication between the petitioner and her counsel, she could not appear before the Trial Court. The petitioner has now deposited Rs.50,000/- towards forfeited bond of Rs.1,00,000/- before the Trial Court on 09.02.2026 in Criminal Miscellaneous No.25102/2023. The petitioner has undertaken to appear before the Trial Court and abide by any conditions to be imposed by this Court. The petitioner has made out a case for grant of anticipatory bail with conditions. - 4 - HC-KAR NC: 2026:KHC:8240 CRL.P No. 14908 of 2025 In the result, the following: ORDER i) The petition is allowed. ii) The petitioner is ordered to be released on anticipatory bail in the event of her arrest in SC No.810/ 2021 (Crime No.229/2020) of Hennur Police Station pending on the file of the learned XXVI Additional City Civil and Sessions Judge at Mayo Hall (CCH-20), Bangalore, registered for offence punishable under Section 302 of IPC subject to following conditions. a) The petitioner shall voluntarily appear before the Trial Court within fifteen days from this day and execute a bail bond for a sum of Rs.1,00,000/- with one surety for the like sum to the satisfaction of the Trial Court. b) The petitioner shall not tamper with prosecution witnesses either directly or indirectly. c) The petitioner shall attend before the Trial Court on all dates of hearing unless exempted and cooperate for speedy disposal of the case. - 5 - HC-KAR NC: 2026:KHC:8240 CRL.P No. 14908 of 2025 The amount deposited by the petitioner shall be appropriated to the State towards the forfeited bond amount.
