1. DEVARAM SRIHARI Counsel for the Respondent:
1. The Court made the following:
3
THE HON’BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA
CIVIL REVISION PETITION NO.210 OF 2026
ORDER:-
The Civil Revision Petition is filed under Article 227 of the Constitution of India seeking early disposal in E.P.No.61/2022 in O.S.No.83 of 2021 on the file of Principal Junior Civil Judge, Addanki.
2. Heard learned counsel for the petitioners. As issuance of notices to the respondent is not necessary in this matter, notice to the respondent is hereby dispensed with. Perused the material on record.
3. The petitioners herein are the plaintiffs and the respondent herein is the defendant in the Suit. For convenience of the court, the parties referred herein are as referred in the suit.
4.
Learned counsel for the petitioners/ plaintiffs submits that the plaintiffs filed suit for specific performance of the agreement of sale dated 22.08.2019 seeking the defendant to execute registered sale deed in respect of the plaint schedule property in favour of plaintiffs and if the defendant fails to execute registered sale deed in favour of the plaintiffs within the time granted by the trial Court, the trial Court itself may execute registered sale deed in favour of plaintiffs and for costs of the suit. The said suit was decreed with costs in favour of the plaintiffs. Subsequently, the plaintiffs filed Execution Petition under Order 21 Rules II Clause I Schedule I seeking the trial court to issue notice to the JDR/ defendant under Order 21 Rule 34, if the JDR failed
4
to execute the sale deed and the trial Court be pleased to execute and Register the sale deed in favour of the plaintiffs/ DHRs. But, so far, trial Court neither disposed of the execution petition nor passed any orders. Aggrieved by the same, the plaintiffs/ petitioners preferred the present revision petition.
5.
Learned counsel for the petitioners further clarified that no claim petition is pending. Even after submission of draft sale deed, the trial Court is not proceeding with the disposal of the execution proceedings. The said action of the trial court is in violation of the orders rendered by the Hon’ble Apex Court on 06.03.2025 in Periyammal (Dead Thr. Lrs.) vs V. Rajamani And Anr. Etc1, wherein, the Hon’ble Apex Court held that the execution petitions pending in various courts shall be decided and disposed of within a period of six months without fail, otherwise the concerned presiding officer would be answerable to the High Court on its administrative side.
6.
Learned counsel for the petitioners/ plaintiffs further submits that even though draft sale deed dated 13.05.2025 has been filed and all the procedural requirements have been complied with, the trial Court kept the E.P pending and is not disposing of the E.P. for one reason or the other. Hence, the learned counsel requests this Court to issue an appropriate direction to the trial Court for speedy disposal of the said E.P.
7. Considering the submissions of the learned counsel for the petitioners and in view of the judgment rendered by the Hon’ble Apex Court as
1) 2025 INSC 329

referred supra and on perusal of the material placed on record, it is settled law that any execution petition filed before the trial court, should be disposed of within a period of six (06) months. In the instant case, the execution petition is filed in the year 2021 for execution of the decree passed in O.S.No.83 of 2021 on the file of Principal Junior Civil Judge, Addanki. It is observed that even after submission of the draft sale deed and even in the absence of any claim petitions before the execution court, but the court postponing the matter for one reason or the other without there being any sufficient reasons, which is certainly contrary to the ratio laid down by the Hon’ble Apex Court as referred supra.
8. In view of the foregoing discussion, this Court is of the considered view that the present Civil Revision Petition can be disposed of, directing the execution Court to dispose of E.P.No.61/2022 in O.S.No.83 of 2021 on the file of Principal Junior Civil Judge, Addanki, within a period of six (06) months from the date of receipt of a copy of this order.
9. With the above direction, the Civil Revision Petition is disposed of. There shall be no order as to costs.
As a sequel, miscellaneous applications pending, if any, shall stand closed. ___________________________________ VENKATESWARLU NIMMAGADDA, J Date:28.01.2026 BSP
