Heard Mr. Suryapratap Yuddhveer Singh, learned counsel for the petitioner. Also heard Mr. Shashank Thakur, learned Additional Advocate General, appearing for the State/respondent No.1 as well as Mr. Anumeh Shrivastava, learned counsel appearing for respondent No.2. 2. After arguing for some time, learned counsel for the petitioner seeks permission of this Court to withdraw the present petition with liberty to file a duly constituted and properly framed petition containing complete and necessary particulars. 3. Taking into consideration the aforesaid submission and upon perusal of the record, this Court finds that the present petition suffers from lack of material particulars and proper pleadings, and 3 therefore, is not in a position to be examined on merits. Consequently, the petition is dismissed as withdrawn with liberty, as sought, to file a properly constituted petition in accordance with law. However, in the interest of justice and to balance equities, the dismissal is made subject to the condition that the petitioner shall deposit costs of ₹5,000/- (Rupees Five Thousand Only) before the Registry of this Court within a period of one week from today. Upon deposit, the Registry is directed to remit the said amount to the Government School for Visual and Hearing Impaired, Tifra, District Bilaspur (Chhattisgarh), for a charitable purpose. 4.
