Case No. 16 of 2025(N) for the offence registered under Sections 20(b)(ii)(c)/29 of the Narcotics Drugs and Psychotropic Substance Act, 1985 pending in the Court of learned Special Judge (NDPS), Ranchi, is pressed into motion. Twenty-Five Kgs., cannabis were sized from the joint possession of this Petitioner and Chandradatt Kumar from Hatia Railway Station. It is submitted by the learned counsel on behalf of petitioner that as per the FIR, only 10 Kgs. were seized from this petitioner which is less than the commercial quantity and therefore, rigors of Section 37 of NDPS Act will not apply. Learned A.P.P. opposed the bail petition. It is submitted that the modus operandi of those involved in drug paddling is that they distribute the consignment of narcotics so as to bring it below the commercial quantity. Under the circumstances, this Court is not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner stands rejected. (Gautam Kumar Choudhary, J.)
