Contention of learned counsel for the applicant is that FIR was lodged making allegation against the applicant that he kidnapped the daughter of the victim and kept her in a small poultry at field wherein the co-accused, Jatin @ Jeevan committed rape upon the victim. It is further submitted that the victim in her statement recorded u/s 180 BNSS made specific allegation of committing rape against the co- accused, Jatin @ Jeevan and specifically stated that applicant has not committed rape upon her. It is further submitted that there is serious contradiction in the statements of victim recorded u/s 180 BNSS and 183 BNSS and medical report of the victim does not substantiate the allegation of rape. It is further submitted that FIR was lodged after three months from the date of incident without any explanation which itself creates doubt over the entire prosecution story. It is further submitted that though there was an allegation in the statements u/s 180 BNSS and 183 BNSS, the applicant and co- accused prepared the obscene video of the victim and blackmailed her but police during investigation could not recover such video or any obscene photograph. Therefore, applicant has been falsely implicated because of village party bandi.
