JUSTICE S.R.KRISHNA KUMAR - 5 - HC-KAR NC: 2026:KHC:18159 WP No. 1720 of 2026 ORAL ORDER In this petition, petitioners seek for the following reliefs:- “a) Issue a writ of Mandamus or any other writ or order or direction directing the respondents to sanction/pay gratuity to the petitioners in terms of the representations submitted to respondents i.e., respondent No.2, Secretary of Government of Karnataka, dated: 04.07.2025, vide Annexure-A & the representation dated: 03.07.2025, vide Annexure-A1 and the respondent No.3 Deputy Commissioner, Tumkur and also the representation submitted by the petitioners to the Director – Respondent No.4 herein, dated: 04.07.2025, as Annexure-A2, to pay gratuity in favour of the petitioners No.1 to 13 respectively, also seeking directing to enforce the Government Order dated 27.03.2025 vide Annexure-D in favour of the petitioners also, based upon the judgment of Apex Court in case No. Civil Appeal No.3153/2022, in the case of MANIBEN MAGAN BHAI BHARIYA VS DISTRICT DEVELOPMENT OFFICER DAHOD and others, dated 25.04.2022 vide Annexure-B. b) Issue Declaratory Writ or Order or Direction; hold/declare that the petitioners are also entitled for gratuity and direct the respondents No.2 to 4 to extend the benefits under the Government Order dated: 27.03.2025 vide Annexure-D to the petitioners also andy pay gratuity to the petitioners along with - 6 - HC-KAR NC: 2026:KHC:18159 WP No. 1720 of 2026 interest at the permissible interest rate of 12% as per payment of Gratuity Act, 1972. c) Pass such other and further order/s, writ/s and directions that this Hon’ble Court may deem fit and proper on facts and circumstances of the case, including the cost of the present proceedings against the respondents No.1 to 4, in the interest of justice and equity.” 2. Heard learned counsel for the petitioners, learned counsel for the respondent No.1 and learned AGA for respondent Nos.2 to 4 and perused the material on record. 3. It is the grievance of the petitioner that his representations dated 04.07.2025, 03.07.2025 and 04.07.2025 at Annexures-A, A-1 and A-2 respectively, submitted to the respondents has not been considered so far by them nor any order has been passed on the same. Under these circumstances, the petitioners are before this Court by way of the present petition. 4. Per contra, learned counsel for the respondents submits that if reasonable time is given, they would consider and pass necessary order on the said representations. - 7 - HC-KAR NC: 2026:KHC:18159 WP No. 1720 of 2026 5. In view of the aforesaid facts and circumstances and rival submissions, the respondents are hereby directed to address the grievances of the petitioners and consider their representations dated 04.07.2025, 03.07.2025 and 04.07.2025 at Annexures-A, A-1 and A-2 respectively and pass appropriate order / take appropriate decision in accordance with law bearing in mind judgment of the Hon’ble Apex Court in the case of Maniben maganbhai Bhariya Vs. District Development Officer Dahod and Ors – Civil Appeal No.3153/2022 and connected matters dated 25.04.2022 at Annexure-B, within a period of three months from the date of receipt of a copy of this order. 6.
