He further submits that no incriminating article has been recovered from the conscious possession of the petitioner and several co-accused persons have already been granted bail in B.A. Nos. 1945/2025, 1972/2025 and 8773/2025 and the petitioner for no offence has been languishing in custody since 20.05.2025; as such, the petitioner may be enlarged on bail. Having regard to the facts of the case and looking to the allegations made against this petitioner coupled with the fact that out of 18 charge-sheeted witnesses, no witness has been examined as such there is no likelihood of early conclusion of trial and also that the co-accused persons have been granted bail and that 2026:JHHC:6684 2 the petitioner is in custody since 20.05.2025; therefore, I am inclined to enlarge this petitioner on bail.
