Thakur, learned counsel for applicant and Ms. N. R. Tripathi, learned APP for respondent/State. 2. The present application is for condonation of delay of 39 days in filing the present criminal appeal against conviction. 3. The present applicant/appellant was convicted by the learned Sessions Court and is sentenced to suffer rigorous imprisonment for life. Shri. Thakur, learned counsel for appellant, submits that the appellant, being a poor person without any financial support, is behind the bars since the date of his conviction. As the appellant’s movement was restricted and he had no sufficient means to prefer the present appeal, there is a delay of 39 days. The delay, therefore, is bona fide and deserves to be condoned. 4. In view of the above, in our considered opinion, the appellant has made out sufficient cause for the aforesaid delay and the application needs to be allowed. 5. Accordingly, the criminal application is allowed and the delay of 39 days is hereby condoned. 6. Accordingly, the present criminal application is disposed of. 2026:BHC-NAG:10332-DB 18 APPA-576-2026 2 CRIMINAL APPEAL (ST) NO.8361 OF 2026 7. Registry is directed to register the criminal appeal.
