Neutral Citation No. ( 2026:JHHC:6529 ) IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No. 1717 of 2026 Birendra Kherwar ... Petitioner Versus The State of Jharkhand … Respondent --- CORAM: HON’BLE MR. JUSTICE RONGON MUKHOPADHYAY --- For the Petitioner : Mr. Pran Pranay, Advocate For the State : APP --- 02/12.03.2026 Heard Mr. Pran Pranay, the learned counsel for the petitioner and the learned A.P.P. The prayer for bail of the petitioner was earlier dismissed as withdrawn in B.A. No. 4041 of 2025. Submission has been advanced by the learned counsel for the petitioner that one of the co-accused Kudrat Ansari has been granted bail in B.A. No. 10307 of 2025. It has further been submitted that the petitioner is in custody since 19.09.2024 and one of the victims as well as the mothers of two of the victims have not supported the case of the prosecution and were declared hostile by the prosecution. Learned A.P.P. has opposed the prayer for bail of the petitioner. It appears that one of the victims has supported the case of the prosecution and so far as Kudrat Ansari is concerned, he has been granted bail on account of the fact that the said victim had categorically stated that Kudrat Ansari had not committed rape upon her and in view of the fact that only two witnesses are now left to be examined apart from the nature of allegations levelled against the petitioner, I am not inclined to grant bail to the petitioner. The same is hereby rejected. (RONGON MUKHOPADHYAY, J.) 12.03.2026 S.B. Uploaded on 13.03.2026
