ORDER: 2 THE HONOURABLE DR JU3TICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 12 OF 2026 ORDER:- The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/Accused No.2 on bail in Crime No.45 of 2021 of Gudur I Town Police Station SPSR Nellore District, registered against the Petitioner/Accused No.2 herein for the offence punishable under Sections 120(B), 302 read with 34 of Indian Penal Code. 2. Heard Mr. M.Siva Prasad, the learned Counsel for the Petitioner and Ms. K. Priyanka Lakshmi, learned Assistant Public Prosecutor. 3. The case of the prosecution, in brief, is that the petitioner absconded from the local limits of the learned Trial Court and deliberately defaulted in making her appearance before the Co^rt for a period of more than one year. As a result, the learned Trial Court could not proceed with the framing of charges. Consequently, the learned Trial Court issued a Non-Bailable Warrant (NBW) against the petitioner on 04.09.2024. The said NBW was executed by the police on 14.10.2025, and the petitioner was remanded to judicial custody. 4. Learned counsel for the petitioner would submit that the petitioner herein is a woman aged about 24 years. The learned counsel would further submit that she is facing allegations for the offences punishable under Sections 120-B and 302 read with Section 34 of the Indian Penal Code in S.C. 3 No.143 of 2023 on the file of th^ VII Additional Sessions Judge, Gudur, SPSR Nellore District. It is submitted that the petitioner could not appear before the Court on 04.09.2024, due to which a Non-Bailable Warrant was issued against her. Upon execution of the NBW, she was produced before the learned trial Court on 14.10.2025 and has been in judicial custody since then. It is further submitted that there was a miscommunication regarding the date of adjournment between the petitioner and her counsel, resulting in her non- appearance. It is further submitted that the petitioner is a woman, has aged parents, and that her non-appearance prior to the issuance of the NBW was not willful. The learned counsel would submit that the petitioner may be released on bail by imposing appropriate conditions to secure her presence during trial. 5. Ms. K. Priyanka Lakshmi, learned Assistant Public Prosecutor, opposed the petition and would submit that th.e trial is scheduled to commence from 23.01.2026 in this matter and that appropriate conditions may be imposed to secure the petitioner’s presence for the purpose of trial. Considering the submissions made, upon perusal of the material on 6. record, and taking into account the facts and circumstances of the case, it is noted that the petitioner was earlier released on bail and failed to appear before the Court that there was a miscommunication regarding the date of adjournment between the petitioner and her counsel, resulting in her non- V 4 appearance. Having regard to the circumstances of the case, and considering that the petitioner is a woman aged about 24 years, this Court is inclined to allow the present petition, subject to the following stringent conditions: The Petitioner/Accused No.2 shall be enlarged on bail subject to her executing a personal bond for a sum of Rs.20,000/- (Rupees twenty thousand only) with two sureties each for the like sum each to the satisfaction of the learned VII Additional Sessions Judge, Gudur, SPSR Nellore District. The learned trial Judge is directed to dispose of the matter as expeditiously as possible without granting any adjournment in a casual way by mere asking. V. y Accordingly, the Criminal Petition is allowed. 7. Sd/-K.TATA RAO DEPUTY REGISTRAR N;r REGISTRAR //TRUE COPY// For ASSISTA To, 1 Th« VU Addl. Sessions Jodga, Gudur. SPSR Nellore Distrio., 2.
