WRIT APPEAL No.69 of 2026 Bench Sr.No:-15 [3446] K. Kalpana ...Appellant Vs. The State of Andhra Pradesh and others ...Respondents ********** Advocate for appellant
: Ms. Y. Maha Lakshmi Advocate for respondents : Learned Government Pleader for Panchayat Raj and Rural Development, learned Government Pleader for Revenue.
CORAM : THE CHIEF JUSTICE DHIRAJ SINGH THAKUR SRI JUSTICE R. RAGHUNANDAN RAO DATE : 29th January 2026 P C : The present Writ Appeal has been preferred against the judgment and
order dated 31.10.2025 passed in Writ Petition No.26543 of 2025.
2. The grievance of the petitioner was that the Gram Panchayat dig a bore well within 20 meters from her bore well situate in Sy.No.409/3 of Tirumalapuram Village, Jangareddigudem Mandal, Eluru District.
3. The case of the petitioner before the learned single Judge was that the action of the Gram Panchayat was violative of Sections 10 and 13 of the Andhra Pradesh Water, Land and Trees Act, 2002 (for short, “the Act of 2002”).
2
4. The learned single Judge, by virtue of the judgment and order impugned, while placing reliance upon the proviso to Section 10 of the Act of 2002, held that while there was a restriction in digging a bore well within 20 meters, which is otherwise in violation of Section 10 of the Act of 2002, yet, since the proviso to Section 10 permitted the bore well if it was for a public purpose, the same would be permissible.
5. We find no illegality in the view expressed by the learned single Judge. The Writ Appeal is without any merit and is, accordingly, dismissed. No order as to costs.
Pending miscellaneous applications, if any, shall stand closed.
