Petitioners have filed this writ petition seeking following reliefs. “10.1 That, the Hon’ble Court may kindly be pleased to issue a writ of mandamus directing the respondents to consider the name of petitioners in the gradation list prepared on 06.11.2024 in Column No. 11, incorporating the B.Ed. Degree instead of D.Ed. as they all had already obtained B.Ed. Degree in the academic session 2023-24 prior to publication of Gradation list on 06.11.2024 for the purpose of promotion by incorporating their B.Ed. Degree necessary qualification requisite for promotion from the post of Teacher (L.B.) to Lecturer/ Head-Master/ Principal, in the interest of justice. 10.2 That this Hon’ble Court may kindly be pleased to issue appropriate writ, directing the respondents to consider the representation made by the petitioners who are been working for the last 20 years in same post Teacher (L.B.) now holding the B.Ed. Degree necessary qualification for consideration of their promotion appropriate post, in the interest of justice. 10.3 Any other relief which this Hon’ble Court may deem and proper in the present circumstances of the case.” 3 / 4 2. Learned counsel for the petitioners submits that petitioners were initially appointed as Assistant Teachers. During period of service, petitioners have obtained the qualification of Bachelor of Education (B.Ed.) in the year 2024. After obtaining the additional qualification of B.Ed., it is also informed to the authorities, however, till date additional qualification has not been entered in the service record of the petitioners. Petitioners have also submitted representation before Respondent No. 2/ Director, Directorate of Public Instructions on 20.03.2025, however, the representation is not considered and necessary entries have not been made in the service record. Therefore, direction be issued to Respondent No. 2 to pass appropriate orders for entering the additional qualification obtained by the petitioners during service period in their service record at the earliest. It is also contention of learned counsel for petitioners that respondents-authorities at any point of time may initiate proceedings of promotion of Teachers and and if additional qualification of petitioner is not entered/ updated in service record, petitioners may not be considered for promotion. 3. Learned State counsel submits that as the petitioners have already submitted representation before the competent authority, ie., Respondent No. 2, their representation will be considered in accordance with law and appropriate orders will be passed. 4. I have heard learned counsel for the respective parties. 5. Taking into consideration the facts and circumstances of the case, nature of grievance raised in this writ petition, in particular the submission of learned counsel for petitioners that petitioner during the period of service have obtained additional qualification of B.Ed., they have also informed the authorities about the additional qualification obtained by them ie, B.Ed. by submitting relevant documents, it is not entered into their service record, against which petitioners have already submitted representation, this writ petition at this stage is disposed of directing Respondent No. 2 to consider 4 / 4 and take decision on the representation of petitioner, Annexure P-5 dated 20.03.2025, in accordance with law, expeditiously preferably within a further period of 04 weeks from the date of receipt of certified copy of this order. 6. If respondents find that petitioners have obtained additional qualification following due process of law, then necessary orders be passed or directions be issued for taking on record their additional qualification making entries of the same in their service record, if there is no other hurdle for the same. 7.
