JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, petitioner seeks the following reliefs: i) Issue a writ of certiorari or any other appropriate writ, order or directions, quashing the impugned official memorandum bearing ¸ÀASÉå: £À.D.E 130 n.JªÀiï.J¸ï. ¨ÉAUÀ¼ÀÆgÀÄ 2025 dated 15.09.2025 passed by the 1st Respondent vide Annexure-A. ii) Issue a writ of mandamus or any other appropriate writ or direction directing the 1st Respondent to - 3 - HC-KAR NC: 2026:KHC:22087 WP No. 28437 of 2025 permit the Applicant to continue to work as Chief Officer, Town Panchayat, Srirampuram, Mysore District to meet the ends of justice. iii) Direct the Respondents to pay the cost of writ proceedings to the petitioner and grant such other relief or reliefs as this Hon’ble Court may be pleased to grant in the interest of justice and equity.” 2. Heard learned counsel for the petitioner and learned AAG along with AGA for respondent Nos.1 to 3 and learned counsel for respondent No.4 and perused the material on record. 3. A perusal of the material on record will indicate that it is the grievance of the petitioner that the impugned order at Annexure – A dated 15.09.2025 whereby the petitioner has been repatriated to the post of Office Assistant, Corporation Division, Department of Urban Development, State of Karnataka. 4. Learned counsel for the petitioner and Learned AAG for the respondents jointly submit that since the petitioner is completing the tenure of two years from 10.06.2024 on 09.06.2026, the present petition may be disposed of directing that the petitioner to be relieved from the post of Chief Officer, Srirampura Town Panchayath, Mysore and to report back to the parent department - 4 - HC-KAR NC: 2026:KHC:22087 WP No. 28437 of 2025 on 20.05.2026 subject to the petitioner filing an affidavit in this regard, within a period of two weeks from today. 5. In view of the joint submissions made by both sides, I deem it just and appropriate to dispose of this petition by issuing certain directions. 6. In the result, I pass the following: ORDER (i) The petition is hereby disposed of without interfering with the impugned order. (ii) It is however made clear that the petitioner shall be entitled to continue to work as Chief Officer – Grade 1, Srirampura Town Panchayath, Mysore upto 20.05.2026 and shall report back to his parent department on 21.05.2026 without seeking extension under any circumstances whatsoever. (iii) Petitioner shall file an affidavit incorporating the aforesaid undertaking within a period of two weeks from today. Subject to the aforesaid directions, the petition stands disposed of.
