ORDER 09.09.2026 Heard Mr. A.R Bhuyan, learned Senior counsel assisted by Ms. L Laskar, learned counsel for the petitioners. Also heard Ms. N.M Sharma, learned Standing Counsel, Secondary Education. The five petitioners before this Court have jointly filed the present writ petition seeking a direction to the respondents to complete the process of selection and appointment of regular Head Masters in respect of the respective schools where the petitioners are presently appointed and working as Graduate Teachers, except petitioner No. 1, who is serving as an Assistant Head Master and is also functioning as the In-charge Head Master. The learned senior counsel for the petitioners submits that the selection process was undertaken in terms of the Notification dated 29.02.2024 by which the process was initiated. The petitioners having satisfied the eligibility criteria had presented their candidatures before the selection committee and as per the information available to the petitioners, their names have already been recommended for being appointed to the post of regular Head Masters in their respective schools. However, although the recruitment process in respect of the other districts across the State of Assam has been completed and incumbents have been regularly appointed in the post of Head Masters. In so far as the district of
Page No.# 4/4 Nagaon is concerned, the selection process has not culminated. The learned senior counsel for the petitioners submits that the non-conclusion of the process for recruitment are for reasons beyond the comprehension of the writ petitioners when similar processes undertaken in the other districts have already been completed. It is submitted that the respondents are liable to be directed to forthwith conclude the process for selection and forward the list of recommended candidates for the Government and the Government should thereafter proceed for passing appropriate orders for appointment of the regular teachers. Ms. N.<. Sharma, learned Standing Counsel, Secondary Education submits on instructions that the selection process has been completed and the select list is likely to be furnished to the office of the Director during the course of the day. Taking into consideration the submissions at the Bar and also taking into
consideration the limited prayer in the writ petition, this Court is of the considered view that the writ petition can be closed at this stage with a specific direction to the respondents more particularly the respondent No. 4 namely, Inspector of Schools to furnish the select list stated to have been made available by the District Selection Committee to be placed before the Director of Secondary Education who upon receipt of the said select list will further forward the same to the respondent No. 1 for passing appropriate order(s) if so required. Let this exercise be completed within a period of 60 (sixty) days from today. Accordingly, the writ petition stands disposed of in view of the above.
