2. It is the case of the petitioner that he resides in the adjoining property to the subject property, i.e., property bearing no. 143/9, Kishangarh, Delhi, where the construction is being raised. He submits that respondent no.3 is raising fresh construction in the form of 4th floor over the existing structure at the subject property without any sanctioned plan from respondent no.1/MCD. 3. Photographs have been filed along with the writ petition showing the construction being carried out by respondent no.3. 4. Mr. Samman Vardhan Gautam, Advocate, appears on behalf of respondent no.3 on advance notice and submits that the construction being raised on the 4th floor shall be demolished by the respondent no.3 within one (1) week from today. He also submits that no further construction shall be carried out in the subject property. 4.1 The statement of the counsel for respondent no.3 is taken on record. 4.2 The respondent no.3 shall be bound by the same. 5. In view of the above statement made by counsel for respondent no.3, the writ petition is disposed of. 6. Liberty is given to the petitioner to approach the Court in the event the aforesaid construction is not removed. This is a digitally signed order.
