( 2026:JHHC:4130 ) IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No. 11850 of 2025 ------ Ajal Ahsan, aged about 34 years, son of Ehsanul Haque, resident of Village-Bhandaridih, P.O. & P.S.-Pachamba, Dist.- Giridih … Petitioner Versus The State of Jharkhand … Opposite Party ------ CORAM: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioner : Mr. Vijay Kumar Roy, Advocate For the State : Mrs. Shweta Singh, Addl. P.P. ------ Order No.03 Dated- 13.02.2026 Heard the parties. The petitioner has been made accused in connection with S.T. No. 412 of 2025 arising out of Bengabad P.S. Case No.58 of 2025 registered for the offences punishable under Sections 64(1) of the B.N.S., 2023 and cognizance under Section 64(1) and 127(2) of the B.N.S., 2023. Learned counsel for the petitioner submits that this is the second journey of the petitioner with the prayer for regular bail and earlier the prayer for regular bail was rejected vide order dated 24.06.2025 in B.A. No. 4956 of 2025. It is next submitted that the only fresh ground is that in the meanwhile, the petitioner has remained in custody for some more months. Hence it is submitted that the petitioner be admitted to bail. Learned Addl. P.P. appearing for the State vehemently opposes the prayer for bail and submits that there is absolutely no fresh ground and keeping in view serious nature of allegation against the petitioner of committing rape; there is every chance of the petitioner absconding and tampering with evidence, if released on bail. It is therefore submitted that the petitioner ought not be admitted to bail. Considering the serious nature of allegation against the petitioner of committing rape upon the victim, after tying her and gagging her mouth with a bundle of clothes as well as the chance of the petitioner absconding and tampering with evidence, if released on bail, this Court is not inclined to admit the petitioner on bail at this stage. Accordingly, the prayer for bail of the above- named petitioner is rejected for the same reasons as mentioned in the order dated 24.06.2025 in B.A. No. 4956 of 2025.
