This is a writ petition filed under Article 227 of the Constitution of India by the petitioner against the impugned order dated 07.03.2026 passed by the learned Principal District Judge, Bemetara in Miscellaneous Civil Appeal No. 2/2026 whereby the application for grant of interim relief filed by the petitioner has been rejected.

Learned counsel for the petitioner would submit that the petitioner is running rice mill in the name and style of M/s Shri Balaji Rice Mill having its registration No. MA504017. On 20.01.2026, his rice mill was being inspected by the Officers of Food Department, State of Chhattisgarh and issued a show cause notice to him with respect to the alleged irregularity of maintaining the stock of the paddy and rice, maintaining the stock register and monthly statement, which is violation under the Chhattisgarh Rice Procurement Order, 2016 (in short, ‘Order of 2016’). Within a short span of time the Collector, Bemetara recommended for cancellation of registration of the rice mill for the year, 2025-26 vide its recommendation dated 28.01.2026. The said recommendation and action of the authorities was challenged by the petitioner by filing its appeal as provided under Clause 11(2) of the said Order of 2016 before the learned Principal District Judge, Bemetara alongwith the application for grant of interim relief. He would further submit that the said license No. MA504017 is valid upto 31.05.2026 and from 31.01.2026, he was stopped from lifting the paddy from the Paddy Procurement Center which put the petitioner in great loss of his business transaction. There is numerous defect in the proceeding of the Collector while inspecting the rice mill of the
3 petitioner and there is every possibility that the petitioner will succeed in the proceeding pending before the learned Principal District Judge, Bemetara in appeal. The application for grant of interim relief filed by the petitioner has been rejected on the ground that there is no prejudice is being caused to the appellant for the reason that the paddy is Government paddy and no interim order can be granted against the lifting of said Government paddy. He would further submit that if the time period mentioned in the license is over, the petitioner would be deprived from lifting of the paddy and thereby, he would be put in irreparable loss of his business transaction, therefore, the petition may be allowed and the petitioner may be permitted to lift the paddy from the Paddy Procurement Center under the relevant rule. 3.
On the other hand, learned counsel appearing for the respective respondents opposes the submissions made by the learned counsel for the petitioner and submits that the appeal filed by the petitioner is pending before the learned Principal District Judge, Bemetara which is fixed on 28.03.2026 and he could get the appeal decided within time and they are ready to co-operate with the proceedings pending before the learned Principal District Judge, Bemetara. 4. I have heard learned counsel for the parties and perused the material annexed with the petition. 5. From perusal of the documents, it transpires that on 20.01.2026, the rice mill of the petitioner was inspected by the Food Department of the state and certain irregularities were noticed by the authorities, for which a show cause notice was issued on 21.01.2026, the said irregularities was with respect to the shortage of the paddy and rice found in the rice
4 mill premises and non-maintenance of its record, in accordance with the Control Order. It also transpires that the said license of the petitioner’s rice mill is valid up to 31.05.2022. The irregularities found during the inspection, maintaining the stock register, lifting the paddy from the Paddy Procurement Center, process of paddy converted into rice and supply of rice to the concerned department FCI/ Nagrik Aapurti Nigam is all amongst to a factual dispute which can be decided in appeal which is pending before the learned Principal District Judge, where the appeal filed by the petitioner is still pending and the next date fixed is 28.03.2026. 6. Considering that the period of license is upto 31.05.2026 and the petitioner was stopped from lifting the paddy from the Paddy Procurement Center, the early disposal of the appeal pending before the learned Principal District Judge, Bemetara is required, so that any inconvenience or prejudice may not have been caused to the petitioner. 7.
Accordingly, the present writ petition is disposed of directing the Principal District Judge, Bemetara to decide the pending appeal of the petitioner (Miscellaneous Civil Appeal No. 2/2026) within 2 weeks from the date of receipt of a copy of this order, in accordance with law and after providing opportunity of hearing to the parties concerned. 8. With the aforesaid observation, the present writ petition is disposed. Sd/-
