JUSTICE PRAVEER BHATNAGAR (THROUGH VIDEO CONFERENCING) Order 18/08/2026 1. The instant second bail application has been filed under Section 483 BNSS by the accused-petitioner. The accused- petitioner has been arrested in connection with FIR No. 432/2025 registered at Police Station Malakhera, District Alwar for the offence punishable under Sections 189(2), 115(2), 127(2) and 109(1) of BNS 2. Learned counsel for the accused-petitioner contended that the first bail application of the petitioner was dismissed by this Court vide order dated 22.05.2026. It is further submitted that subsequent to the dismissal of the first bail application, the statements of witness Bhag Chand, who is victim in the present [2026:RJ-JP:33005] (2 of 3) [CRLMB-10919/2026] case were recorded before the learned Trial Court, wherein he specifically attributed the injuries sustained by him to the present petitioner as well as co-accused Babu Lal @ Babu Saini. Learned counsel further submits that the first bail application preferred by co-accused Babu Lal @ Babu Singh was also dismissed by the co- ordinate Bench of this Court, however, after recording of the statements of Bhag Chand his subsequent bail application was allowed by the co-ordinate Bench vide order dated 12.08.2026. It is also contended that the case of the present petitioner is similarly situated and is not distinguishable from that of co- accused Babu Lal @ Babu Singh. Therefore, in view of the aforesaid facts and circumstances, it is prayed that the second bail application of the accused-petitioner be allowed. 3. Learned Public Prosecutor and learned counsel appearing for the complainant have vehemently opposed the bail application. It is contended that Bhag Chand in his statement recorded before the learned Trial Court has specifically stated that the present petitioner along with the other co-accused inflicted a blow at his head resulting in an injury which was opined to be dangerous to life. It is further submitted that injured Bhag Chand remained hospitalized for a period of 14 days. In view of the nature and gravity of the injuries sustained by the victim and the specific allegation against the present petitioner. 4. Heard learned counsel for the parties and perused the material available on record. 5. It is not apposite for the Court to express anything on the merits of the case at this stage. However, after dismissal of the first bail application, the statements of the injured/victim, PW-6 [2026:RJ-JP:33005] (3 of 3) [CRLMB-10919/2026] Bhag Chand, were recorded before the learned Trial Court. It is also not in dispute that on consideration of the said statement the similarly situated co-accused Babu Lal @ Babu Saini has been enlarged on bail by the co-ordinate Bench vide order dated 12.08.2026. The case of the present petitioner is not distinguishable from that of the said co-accused. Considering the aforesaid changed circumstance and maintaining parity with the co-accused, this Court deems it just and proper to allow the present bail application. 6. Accordingly, the second Bail Application of the accused- petitioner is hereby allowed. The accused-petitioner Manish Saini S/o Ramkishore @ Pappu Tailor, shall be released on bail in pursuance of FIR No. 432/2025 registered at Police Station Malakhera, District Alwar on furnishing a personal bond of Rs. 50,000/- along with two sureties of Rs. 25,000/-each to the satisfaction of the learned Trial Judge for his appearance before the Court on each and every date of hearing and whenever called upon to do so.
