2. This is an application filed under Section 483 of the BNSS, 2023 seeking regular bail for the accused/petitioner, Lalchan Hoque@ Lalchand Hoque, who was arrested on 20.07.2026 in connection with Gossaigaon P.S Case No. 145/2026, u/s 85/123/296/3(5) of the BNS, 2023.
3. The allegations against the accused/petitioner, as stated briefly in the FIR, are that the accused/petitioner, along with other co-accused persons named in the FIR, subjected the informant, i.e., the wife of the petitioner, to physical and mental torture and forced her to consume poison. Being unable to bear the torture, she attempted suicide by consuming poison. The accused persons were arrested following the registration of the FIR and have by now spent 52 days in custody, while the statutory period of detention in the instant case is 60 days.
4. It appears that the petitioner, upon being produced before the learned Magistrate, was straightaway remanded to jail custody as the IO did not pray for police remand.
5. Considering the above, as well as the nature of the allegations and the period of detention already undergone, further detention of the petitioner does not appear to be necessary.
6. Accordingly, the prayer for bail is allowed.
