JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court, seeking the following prayers: “i) Quash the entire proceedings in C.C.No.36524/2024 pending on the file of the Learned VI Addl. Chief Judicial Magistrate, at Bengaluru in so far as the Petitioners are concerned; (ANNEXURES 'C' and 'D') ii) Pass any other orders in favour of the Petitioners, considering the facts and circumstance of the present case in the interest of justice.” 2. Heard Sri.Charan N.S, learned counsel appearing for the petitioners, Sri.B.N.Jagadeesha, learned Addl. SPP appearing for respondent No.1, Sri.Shreyas S, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the subsistence of the proceedings, the parties to the lis have entered into a settlement and have settled the dispute by filing Compounding Application along with Joint Affidavit drawing up certain terms of settlement. The - 4 - HC-KAR NC: 2026:KHC:8186 WP No. 4219 of 2026 compounding application filed by the parties to the lis reads as follows: "APPLICATION UNDER SECTION 528 OF BHARATIYA NAGARIK SURAKSHA SANHITA READ WITH SECTION 359 OF THE BHARATIYA NAGARIK SURAKSHA SANHITA. The Petitioners above named respectfully state as under: 1. The Petitioner states that the instant application may be treated as part and parcel of the main petition to avoid repetition of facts. 2. The Petitioners have preferred the instant Writ Petition challenging the entire proceedings in C.C No. 36524/2024 pending on the file of the Learned VI Addl. Chief Judicial Magistrate, at Bengaluru for the offences punishable under Sections 115(2), 118(1), 126(2), 351(2) and 352 read with Section 3(5) of the Bharatiya Nyaya Sanhita. 3. It is respectfully stated that the Petitioners and the Respondent No. 2 due to intervention of elders, friends and well-wishers have settled the matter amongst themselves amicably and the Respondent No. 2 no longer wishes to prosecute the impugned proceedings against the Petitioners. 4. The Petitioners further state that it has been agreed that the Respondent No. 2 would not prosecute the instant criminal case as both the Petitioners and the Respondent No. 2 have settled the matter and hence the Respondent No. 2 has no objections for quashing, closing, compounding of the proceedings in C.C No. 36524/2024 pending on the file of the Learned VI Addl. Chief Judicial Magistrate, at Bengaluru for the offences punishable under Sections 115(2), 118(1), 126(2), 351(2) and 352 read with Section 3(5) of the Bharatiya Nyaya Sanhita. WHEREFORE, the Petitioners and the Respondent No. 2 humbly pray that this Hon'ble Court be pleased to allow the instant application and permit the Petitioners and Respondent No.2 to compound the offences as alleged against the Petitionersand further to quash the proceedings in C.C No. 36524/2024 pending on the file of the Learned VI Addl. Chief Judicial Magistrate, at Bengaluru for the offences punishable under Sections 115(2), 118(1), 126(2), 351(2) - 5 - HC-KAR NC: 2026:KHC:8186 WP No. 4219 of 2026 and 352 read with Section 3(5) of the Bharatiya Nyaya Sanhita, in the interest of Justice." 4. In the light of application for compounding being filed along with the joint affidavit and offences not being against the State, I deem it appropriate to accept the compounding application and terminate the proceedings against the petitioners in the subject petition. 5. For the aforesaid reasons, the following: O R D E R [I] Criminal Petition is disposed. [II] Proceedings in C.C.No.36524/2024 pending before the VI Addl.
