1. Petitioners have filed this petition under Article 226 of the Constitution of India seeking following reliefs:
“10 RELIEFS SOUGHT: A. Issue an appropriate writ, order or direction, directing Respondent No.2 to decide and dispose of the pending revenue case (Revenue Case No.20161128080000001/A-6) in a time- bound manner, in accordance with law; B. Issue an appropriate writ, order or direction, directing the respondent authorities to correct and restore the revenue records pertaining to Khasra No.2921/3 in accordance with the findings of the Patwari report dated 24.11.2021 and other relevant records; C. Issue an appropriate writ, order or direction, directing the respondent authorities to ensure protection of the petitioners' possession and property rights over the disputed land;
3 D. Pass any other order(s) or direction(s) as this Hon'ble Court may deem fit and proper in the
facts and circumstances of the case; E. Award costs of the present petition in favour of the Petitioners.”

Learned counsel for the petitioners submits that the petitioners are the legal heirs/representatives of Late Shri Govind Prasad Gupta, who was a co-sharer in the land bearing Khasra No. 2921, area 2.13 acres, situated at Village Pendra, Tehsil Pendra, District Gaurella-Pendra-Marwahi (C.G.). In the year 1987-88, a family partition took place among the co-sharers, pursuant to which land measuring 0.77 acres fell to the share of late Govind Prasad Gupta, thereafter, said land was recorded in his name under the new Khasra No.2921/3 in the revenue records for the year 1988-89. Subsequently, in the year 1992- 93, an error crept in the revenue record showing area of Khasra No.2921/3 to be 0.56 acres with a note that 0.21 acres of aforesaid area/land has been sold, however, late Govind Prasad Gupta has never sold any land/area of the said land to anyone, therefore, late Govind Prasad Gupta filed an application dated 26.10.2016 under Sections 115 & 116 of the C.G. Land Revenue Code, 1959 before the concerned respondent-authority for correction of record, to which, various reports were called for by the concerned respondent-Authority and, thereafter, case has been registered as Revenue Case No.20161128080000001/A-6, which is still pending

consideration since the year 2016. Hence, it is prayed that respondent No.2/Sub-Divisional Officer (Revenue) be directed to consider and decide the pending revenue case in accordance with relevant rules/law within an stipulated time frame.
3. Learned State Counsel submits that he is having no objection to the limited prayer made by counsel for the petitioner.
4. Heard learned counsel for the parties.

Having considered the aforesaid facts and prayer made by counsel for the petitioners, particularly that said revenue case is pending consideration since 2016, without entering into the merits of the case, the instant petition is disposed of directing respondent No.2/SDO, Revenue to consider and decide the pending Revenue Case No.20161128080000001/A-6 in accordance with relevant rules/law as early as possible, preferably within an outer limit of ‘60 days’ from the date of receipt of copy of this order.
6. Interim application, if any, also stands disposed of. CC as per rules.
