A memo is filed by learned counsel for the revision petitioner. Memo reads as under: The Revision Petitioner most respectfully submits as follows: 1. The above Criminal Revision Petition is filed challenging the Judgment of Conviction and order of sentence dated 25.01.2023 passed by the Learned LXXII Additional City Civil and Sessions Judge, Bengaluru in Criminal Appeal No. 25216/2022, whereby the learned Sessions Court was pleased to confirm the Judgment of Conviction and sentence dated 21.07.2022 passed by the Learned XXXIII ACMM, Bengaluru in C.C. No. 54058/2018 for the offence punishable under Section 138 of the Negotiable Instruments Act sentencing the accused to pay 3,75.000/- towards cheque amount of 3,00,000/- - 3 - HC-KAR NC: 2026:KHC:17229 CRL.RP No. 402 of 2023 2. It is submitted that during the pendency of Criminal Appeal No. 25216/2022, the Petitioner, in compliance with the statutory mandate under Section 148 of the Negotiable Instruments Act, has deposited 20% of the fine/compensation amount that is 77,500/- as directed by the Appellate Court. 3. The Petitioner most humbly submits that he undertakes to pay the remaining amount of ₹2,97,500/- in three instalments within a period of three months from today, as per the following schedule: SI. No. Instalment Description Amount Amount Due Date 1 First Instalment 99,000 26.04.2026 2 Second Instalment 99,000 26.05.2026 3 Third and Final Instalment 99,500 26.06.2026 4. The Petitioner undertakes to strictly adhere to the above schedule, failing which he shall be liable for such consequences as this Hon'ble Court may deem fit in the interest of justice.” 2. Learned counsel for the respondent has endorsed no objection on the memo. 3. Amount in deposit is ordered to be withdrawn by the complainant under due identification. 5. It is made clear that if any of the installment of compensation amount is not paid as agreed in the memo, revision petitioner shall undergo imprisonment as ordered by the learned Trial Magistrate confirmed by the First Appellate Court.
