Serial No. 45 REGULAR LIST IN THE HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR CrlM(180/2026) IN CrlA(D) 10/2026 UNION TERRITORY THROUGH POLICE STATION BANDIPORA …Petitioner/Appellant(s) Through: Ms. Maha Majeed, AC vice Mr. Mohsin Qadri, Sr. AAG Vs. TAHIR HUSSAIN MIR AND OTHERS ...Respondent(s) Through: Mr. B.A.Tak, Advocate CORAM: HON’BLE MR. JUSTICE RAJNESH OSWAL, JUDGE HON’BLE MR. JUSTICE SANJAY PARIHAR, JUDGE ORDE R 01.06.2026 CrlM No. 180/2026 1. This is an application seeking condonation of delay of 241 days in filing an appeal against the order dated 28th May, 2025, read with order dated 22nd July, 2025, whereby the learned Additional Sessions Judge [Special Judge designated under the NIA Act] Bandipora (hereinafter referred to as the “trial court”) initially granted interim bail and subsequently made the same absolute. 2. Pursuant to a specific query made by this Court, learned counsel appearing for the appellant has stated that till date, the chargesheet has not been filed. 3. We have examined the orders passed by the learned trial court and find that the learned trial court, after taking into consideration that FIR No. 4/2024 had been registered for offences under Sections 10 & 13 of the UAP Act, wherein the respondents were arrested in April 2025, and that no further recovery was to be made from them, granted bail, in favour of respondents. 4. The conclusion drawn by the learned trial court while granting the bail is unexceptional. 5. The appellants have not demonstrated sufficient cause for condoning delay and, accordingly, we do not find any merit in this application and the same is, as such, dismissed. Consequently, the appeal bearing CrlA (D) No. 10/2026 is also dismissed. (SANJAY PARIHAR) (RAJNESH OSWAL) JUDGE JUDGE SRINAGAR: 01.06.2026 “ARIF”
