GP FOR HOME The Court made the following: 2 ORDER: The Writ Petition has been filed for the following relief: “…to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction of Respondents No. 2 and 3 in not conducting a proper investigation into Crime No.85/2025 of Cheepurupalli P.S. as illegal and arbitrary and consequently direct the Respondents to conduct a proper and fair investigation into the FIR, including the examination of suspects and Call Data Records,as per law and pass…” 2. Heard learned counsel for the Petitioners and the learned Assistant Government Pleader. 3. Sri K.Leela Hari Prasad, learned Counsel for the Petitioners submits that the Respondent Nos.2 & 3 are not conducting investigation in proper lines in Cr.No.85/2025 of Cheepurupalli Police Station and urged to direct the Respondent Police to conduct proper and fair investigation. 4. Sri P.Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that in Cr.No.85/2025 of Cheepurupalli Police Station, the police filed final report stating that the death of the son of the Petitioner as suicide. 5. Indeed, the Petitioners have got an alternative efficacious remedy available under the provisions of ‘the BNSS’ by way of filing a protest petition in accordance with law before the learned Jurisdictional Magistrate. 6. Having regard to the entire facts and circumstances of the case, the Writ Petition is disposed of, requiring the Petitioners to file a protest petition before the learned Jurisdictional Magistrate against referring the case as suicide. 3 7. With the above observations and directions, the Writ Petition is disposed of. There shall be no order as to costs.
