Heard Mr. Sunil Otwani, learned Senior Advocate, assisted by Mr. Deepak Sharma, learned counsel for the petitioners. Also heard Mr. Sourabh Sahu, learned Panel Lawyer, appearing for the State/respondent No. 1. 2. The present petition has been filed by the petitioners with the following prayer: “It is therefore humbly prayed that the Hon’ble Court may kindly be pleased to quash FIR No. 80 of 2025 dated 10.12.2025 registered at PS Mahila Thana, Durg, District Durg and subsequent proceedings against the present petitioner for offence under Section 85 read with Section 3(5) of BNS which is a gross abuse of process of law, illegal and against the provision of law and thus, may kindly be quashed in the interest of justice. Any other relief which this Hon’ble Court may 3 deem fit and proper may also kindly be granted to the petitioner in the interest of justice.” 3. A perusal of the Mediation Centre report dated 23.03.2026 reflects that the mediation proceedings between the parties have been successful. As per the terms of settlement, a total sum of Rs.17,00,000/- was agreed to be paid by way of Demand Drafts, namely Demand Draft No. 241405 dated 17.03.2026 for Rs. 8,00,000/- and Demand Draft No.873297 dated 29.03.2026 for Rs. 9,00,000/-, both drawn on State Bank of India, Branch Bhilai-3. This Court, vide order dated 24.03.2026, remitted the matter to the Mediation Centre directing the parties to appear at 3:30 p.m. and further directed that the aforesaid Demand Drafts be handed over to respondent No. 2 upon due verification of her identity. A further perusal of the Mediation Centre report dated 24.03.2026 indicates that the said Demand Drafts have been duly handed over to respondent No. 2 after due verification of her identity. 4. From the aforesaid Mediation Centre reports, it is apparent that the petitioners and respondent No. 2 have amicably resolved their dispute and arrived at a settlement, and that the entire settled amount of Rs. 17,00,000/- stands paid and received in terms thereof. 5. In view of the aforesaid settlement arrived at between the parties and the fact that the terms thereof have been duly complied with, this Court is of the considered opinion that continuation of the criminal proceedings against the petitioners would serve no useful purpose. 6. Accordingly, the impugned FIR bearing Crime No. 80 of 2025 4 dated 10.12.2025 registered at Police Station Mahila Thana, Durg, District Durg (C.G.) for offence under Section 85 read with Section 3(5) of BNS and all consequential proceedings arising therefrom are hereby quashed, subject to the condition that the petitioners shall abide by the terms and conditions of the settlement arrived at between the parties. 7.
