The order impugned in the present petition is an order of interim maintenance passed by the learned Principal District Judge, Family Court, Nagpur, on application at Exhibit 7 dated 09.04.2026 in Petition No.A- 834 of 2025. 2. The learned Family Court has recorded finding on the basis of affidavit of the petitioner/husband that his gross monthly salary is Rs.82,000/- and after making deduction of taxes and other statutory dues, his net monthly salary is Rs.69,000/-. The other deductions in the salary are rightly discarded since they are not in nature of taxes or government dues. The husband has opposed the application for grant of interim maintenance principally on the ground that the wife was in private employment and was earning salary of around Rs.30,000/- per month. However, this contention is not accepted by the learned trial Court since no documentary evidence in this regard is placed on the record by the husband. 2026:BHC-NAG:8766 2 21.wp.5280.2026.odt 3. The learned Family Court has also referred to the affidavit filed by the wife and documents accompanied thereto to hold that her version that she was not gainfully employed was prima facie acceptable. With such finding, the learned Family Court has granted maintenance at the rate of Rs.9,000/- per month. 4. Having regard to the monthly net salary of the petitioner/husband which is Rs.69,000/- and the amount of monthly maintenance of Rs.9,000/- awarded under the impugned order, this Court sees no reasons to interfere with the impugned order.
