And In the matter of : Himangshu Mondal @ Himangshu Mandal. ……Petitioner. Mr. Tapodip Gupta Mr. Suman Bhanja ……for the Petitioner. Mr. Joydeep Biswas Mr. Rahul Ganguly ……for the State. Learned advocate for the petitioner draws the attention of the Court to the order of the Hon’ble Apex Court dated 04.02.2026 passed in Special Leave to Appeal (Crl.) No(s). 18820/2025 wherein other accused persons who were travelling in the car and similarly placed accused person has been granted bail. Having considered that it is very difficult to distinguish the present petitioner from the petitioner who has been granted bail, I am inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner is allowed. As such, petitioner namely, Himangshu Mondal @ Himangshu Mandal shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court under 2 NDPS Act cum learned Additional District & Sessions Judge, 2nd Court, Berhampore, Murshidabad. Learned Special Court is directed to impose such terms and conditions as it deems fit and proper for ensuring the appearance of the petitioner. Accordingly, the prayer for bail in CRM (NDPS) 279 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
