By way of the present petition, the petitioner is seeking following prayers: “...a) Issue a writ of Certiorari or any other appropriate writ, order or direction quashing and setting aside the Impugned Order dated 07.08.2026 passed by the Competent Authority of Respondent No. 1, whereby the Petitioner and its allied concerns have been banned from participating in all tenders of ONGC for a period of six months, i.e. from 20.04.2026 to 19.10.2026; b) Issue a consequential writ of Mandamus or any other appropriate writ, order or direction directing the Respondents to restore the Petitioner and its allied concerns to their position of eligibility for participation in the tenders, bids and procurement processes of ONGC, as if the impugned Banning Order dated This is a digitally signed order. The Order is downloaded from the DHC Server on 20/08/2026 at 11:20:39 07.08.2026 had not been passed; c) Issue a consequential writ of Mandamus or any other appropriate writ, order or direction directing the Respondents to withdraw, recall and/or reverse any consequential action taken pursuant to the Impugned Order, including any communication or action on the Government e-Marketplace ("GeM"), insofar as the same affects the Petitioner's eligibility or ability to participate in Government procurement; d) In the alternative, in the event this Hon'ble Court is not inclined to grant the reliefs prayed for hereinabove at this stage, issue an appropriate writ, order or direction directing the Respondent Appellate Authority to consider and decide the Petitioner's appeal dated 11.08.2026 against the Impugned Order dated 07.08.2026, by a reasoned and speaking order, within a time-bound period and after granting the Petitioner an effective opportunity of hearing, and to consider the Petitioner's request for interim protection against the operation and implementation of the impugned Banning Order pending disposal of the appeal; e) Pending the hearing and final disposal of the present Writ Petition, stay the operation, implementation and effect of the impugned Banning Order dated 07.08.2026 and permit the Petitioner and its allied concerns to participate in all present and future tenders and procurement processes of ONGC, and direct that the impugned banning action shall not be given effect to on GeM or otherwise; f) Award the cost of the present Writ Petition in favour of the Petitioner and against the Respondents...” 2. Issue notice. 3. Mr. Abhishek Puri, the learned senior panel counsel accepts notice on behalf of respondent nos. 1 to 3. 4. Having heard the learned counsels appearing for the parties, this Court directs the competent authority to decide the appeal of the petitioner herein which is pending before the Appellate Authority within a period of two weeks from date, under intimation to the petitioner and this Court. 5. The petitioner is at liberty to approach this Court again, in case the need so arises, by way of filing a fresh writ petition. This is a digitally signed order.
