Heard the learned Counsel appearing for the applicant and the learned Counsel appearing for non-applicant No.2. None appears for non-applicant Nos.3 and 4. 02. By the present application, the applicant seeks permission to bring the legal heirs of deceased non-applicant No.1-Narendra Janrao Yengade, who died on 14/08/2025 in a railway accident during the pendency of the revision, on record. The present application is filed well within the period of limitation. 03. The applicant has filed an affidavit of service bearing St. No.3/2026 stating therein that Nanda Kishor Yengade and Krishna Kishor Yengade have been duly served with notice by Speed Post. The postal tracking report is also placed on record along with the affidavit. Since the cause of action survives and non-applicant No.1 died during the pendency of the present revision, the applicant is permitted to bring the legal heirs of non-applicant No.1 on record. 2026:BHC-NAG:12988 924.cac.41.26 2/2 04. In view of the above, the application is allowed. Necessary amendments be carried out in Civil Application (CAC) No.9/2025 as well as in Civil Revision Application St. No.20499/2024 within a period of seven days from today. 05. After the amendments are carried out, issue fresh notice to the legal heirs of deceased non-applicant No.1, returnable on 13th October, 2026.
